Three Women Arrested After Nursing Home Fight

On June 21st, 2019, police in North Carolina received a report of elder abuse involving two female residents at a nursing home. An investigation was conducted and what was discovered was disturbing.

According to a police report, the two female residents involved in the abuse are two women who suffer from cognitive disorders. The three women who were ultimately arrested worked at the nursing home and were charged with caring for the 70-year-old and 73-year-old residents.

One at least two occasions, the employees encouraged the two women to fight, going so far as to push them together and film the incidents. They allegedly stood on the sideline cheering them on in the videos.

The three women have been arrested and charged with assault on an individual with a disability.

The nursing home has released a statement saying that they have a zero-tolerance policy for the mistreatment of those in their care.

Department Of Health Has Issued Over $2 Million Dollars In Fines To Nursing Homes In 2019

According to the Pennsylvania Department of Health, more than 80,000 individuals live in nursing homes in this state alone. It is the Department’s job to make sure that the more than 700 facilities providing care to these residents are following all of the rules.

Each month, surveys are taken of various facilities, which is an inspection to check overall building safety and patient care. If it is found that the nursing home is failing to properly care for residents or if hazards are discovered in the building, the Department of Health takes action. Fines can be issued and the Department can even place a ban on admissions or revoke a license.

In the legal complaint, the plaintiffs noted that their loved one had been living in the nursing home since 2013. At the time of her death in 2016, she was found to be quite malnourished and her body was covered in rashes caused by the scabies mite.

When a patient has scabies, the mites burrow below the skin and feed on blood. They also lay eggs. The mites cause a rash that is severely itchy and can result in infection.

Scabies is passed from person to person through skin to skin contact or by coming into contact with the clothing or bedding of an infected person. This is why a scabies outbreak must be treated immediately and taken seriously, especially in a nursing home where many residents already have a weakened immune system.

Instead of taking immediate action, the plaintiffs allege that the nursing home did not notify the Health Department, a doctor, or the family about the resident’s condition. According to one of the legal complaints, the resident, an elderly woman, was taken to the hospital on February 27th, 2018. While going to the hospital was the right course of action, the decision to seek medical care was far too late. 

Throughout the day, the lawsuit alleges that the patient was “screaming, crying, and bleating” because of the pain she was experiencing. She was only given a mild pain killer which didn’t help. She was allowed to suffer for hours. Then, later in the day, her caretakers were unable to find her pulse or get a blood pressure reading. Instead of taking immediate action, the staff waited three hours before calling for an ambulance. 

The resident died in the hospital later that day. Her physicians say she was severely dehydrated and may not have been given water for three days. 

A second resident also died on the same day and was noted to have significant weight loss and was unresponsive. A report was made by the hospital and state officials alerted. The state investigated and the nursing home was fined nearly $78,000 for various issues that were discovered. This isn’t the first time that an investigation has resulted in fines at that particular facility.

Nursing Home And Aide Sued After Sexual Assault

In 2017, Continuing Healthcare hired Ronald Whisman Jr. as a nurses aide. The nursing home claims they did a background check on Whisman and there were no red flags. But in 2018, another employee opened the door to a patient’s room to find Whisman with his pants around his ankles, engaging in a sexual act with the patient. 

The employee called the police and reported Whisman. Officers discovered that the patient that Whisman assaulted was a 68-year-old woman with dementia. She was taken to the hospital and treated for the assault. 

Whisman initially claimed the other employee was mistaken and that he was only changing the patient’s diaper. But he later pleaded guilty to two felony counts of sexual battery and a felony count of gross sexual imposition. He is now serving a 5-year prison sentence and will have to register as a sex offender when he is released. 

The daughter of the victim filed a lawsuit against both Whisman and the nursing home. Her legal complaint states that her mother is incapable of resisting or giving consent because of her medical condition. She further alleges that the nursing home failed to protect her mother from a predator despite knowing she was frail and unable to defend herself.

Nursing Home Faces Multiple Civil Lawsuits

A nursing home in Summerville, South Carolina is facing multiple civil lawsuits and numerous DHEC violations, alleging that residents have suffered and even died from poor care

Lawsuit Alleges Nursing Home Resident Suffered Until She Died 

One of the lawsuits that was recently filed against Oakbrook Health and Rehabilitation Center alleges that a female resident wasn’t properly cared for during her time in the facility which lasted from 2012 to 2017. 

Her loved ones claim that those in charge of her care failed to properly monitor her vital signs and that when she began to decline, doctors were not informed. Ultimately any care she did receive was too late. 

The second lawsuit is also filed by the family of a former resident who alleges that the nursing home staff administered the incorrect medication which caused her to overdose. According to the legal paperwork, the patient was given five medications, Morphine, Amitrityline, Gabapentin, Ropinirole and Zoloft. These medications were actually meant for another patient. The nurse in charge was not notified of the incident until nine hours later when she was finally taken to the hospital to be treated for an overdose. 

A month later the same patient fell while in the bathroom due to lack of supervision.

DHEC Investigates Nursing Home

The Department of Health and Environmental Control was alerted to possible issues with medications at the nursing home facility. Their team investigated and reported that there were more than 2,000 documents showing proof of the late administration of medication and late charting of those medications. Now the facility is facing numerous violations.

Nursing Home Resident Dies After Being Dropped

A federal nursing home lawsuit has been filed and is claiming that a Lehigh County nursing home’s failure to properly staff directly resulted in the death of a resident.

On July 5th, 2017, a female resident, who was in the facility because she was completely dependent upon others and required constant care, was being moved from her bed by a certified nursing assistant. The CNA was attempting to move the patient alone when they lost their grip and dropped the resident. 

The resident landed on her face and knees. Her weakened condition caused her femur to fracture and other serious injuries. She was rushed to the hospital for treatment but the stress of her injuries caused her to go into cardiac arrest. After being revived multiple times, her body gave out and she died. 

A lawsuit has been filed by the resident’s loved ones, alleging that Cedarbrook Nursing Home was “intentionally and grossly understaffed” and that the resident’s level of care suffered as a result, putting her in a dangerous situation. The legal complaint also alleges that the nursing home has failed to provide the resident’s complete medical records.

Although it’s true that physical abuse in nursing homes often occurs when staff abuse a resident, in many cases, the abuse occurs between two residents. One nursing home is now being sued for failing to protect one elderly resident from the violence caused by another. 

Lawsuit Alleges Nursing Home Is Purposefully Understaffed

For the second time, a nursing home is facing a lawsuit alleging that they failed to prevent violence between residents in the dementia and Alzheimer’s wing. 

Per the complaint, a resident called “Anna” attacked another resident, a 92-year-old woman with dementia. She struck the wheelchair-bound patient across the face. Now, the victim suffers from recurring headaches and anxiety that she did not have prior to the attack. 

The legal complaint also indicates that the same woman attacked another resident who was awarded $3.6 million for the trauma he sustained. In that alleged attack, Anna slapped, punched, bit, and scratched the elderly man. 

In both cases, the plaintiffs allege that the nursing home places more importance on making money than it does keeping residents safe. They claim that the nursing home is chronically understaffed in order to save money and that if staffing was at the correct levels, these attacks wouldn’t have happened.
