A woman has filed a lawsuit against her mother’s nursing home, seeking a billion dollars for the pain, suffering, and humiliation experienced by her elderly mother.
Sexual predators generally seek to assault those that they perceive as weak and helpless because they understand that it reduces the risk of getting caught, allowing them to continue spreading pain. The only way that the sexual assault stops is if it is reported and if the elderly victim is unable to do so, someone must speak up for them.
That’s exactly what one woman did for her mother.
In 2011, the woman who has filed a lawsuit against her mother’s nursing home was forced to put her mother into the home because of her progressive Alzheimers. For many years, her mother appeared to do well in the nursing home and the plaintiff visited her every single day. Then, in August 2018, she noticed something disturbing.
While giving her mother a bath, the plaintiff noted extreme swelling and bruising around both her mother’s vagina and rectum. She immediately reported the physical signs to the nursing home director but was ignored. The next day when she checked on her mother again she discovered additional bruising and worse swelling. Realizing that something was horribly wrong, she took her mother to the hospital.
An exam was performed and doctors informed her that her poor mother had been repeatedly raped and sodomized. She cannot speak because of her Alzheimers and could not report the horrific assaults which doctors estimated had been going on for weeks.
The plaintiff called the police and although a possible suspect was identified, no arrest has been made. Regardless of possible future criminal charges, the victim’s family wants answers and wants the nursing home to answer for failing to protect her.
This isn’t the first time that this nursing home has been held accountable for the abuse that patients have experienced behind its walls. The facility has reportedly been flagged in the past for failing to investigate and report the abuse of residents in the past. Additionally, they have failed to perform background checks when hiring. They’ve been fined $78,000 in the past by Medicare for their practices.
A nursing home lawsuit can help in two ways. First, it can help provide a much-needed sense that justice has been served, especially if local law enforcement hasn’t moved forward with criminal charges. Additionally, a settlement or verdict can provide your family with the funds that are needed to ensure your loved one gets proper care.
The total amount that can be obtained through a lawsuit varies in each case and depends on the abuse and neglect that has occurred.
